Agreement to Terms

By downloading, accessing, or using the Clover mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the App. These Terms apply to all users of the App on iOS and Android devices.

Description of Service

Clover is a mobile application that helps parents and caregivers locate baby changing facilities, family restrooms, high chairs, and nursing rooms. The App provides:

• An interactive map showing nearby baby-friendly facilities
• The ability to search for specific locations
• Community-contributed information including photos and reviews
• The ability to contribute new places and photos to help other users

Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use this App. By using the App, you represent and warrant that you meet this age requirement. The App is intended for parents, caregivers, and individuals seeking baby-friendly facilities.

Use of Service

Acceptable Use

You agree to use Clover only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit false, misleading, or inaccurate information about facilities
• Upload inappropriate, offensive, illegal, or sexually explicit content
• Upload photos containing identifiable children without proper consent
• Harass, abuse, threaten, or harm other users
• Attempt to gain unauthorized access to our systems or networks
• Use automated tools, bots, or scripts to scrape or collect data
• Interfere with, disrupt, or impose an unreasonable burden on the service
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Use the App for commercial purposes without our permission

Location Services

The App requires location permissions to function properly. You may grant or deny location access at any time through your device settings. Without location access, some features of the App may not work as intended.

Device Permissions

The App may request the following permissions:

• Location: To display your position on the map and show nearby facilities
• Camera: To take photos of facilities (optional)
• Photo Library: To select and upload photos (optional)

You can manage these permissions at any time in your device settings.

User Contributions

Types of Contributions

You may contribute to the App by:

• Adding new baby-friendly facilities
• Uploading photos of facilities
• Providing feedback on existing facilities
• Reporting incorrect or outdated information

Content Ownership and License

You retain ownership of all content you submit to Clover. However, by submitting content (including photos, location information, and reviews), you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App and our business.

This license allows us to make your contributions available to other App users to help them find baby-friendly facilities.

Content Guidelines

All user contributions must:

• Be accurate and truthful to the best of your knowledge
• Not contain personal information of others (names, addresses, phone numbers)
• Not include copyrighted material you don't have permission to use
• Be appropriate for a family-friendly, all-ages service
• Not contain identifiable photos of children without proper consent
• Not promote commercial products, services, or businesses
• Not contain spam, advertising, or solicitation
• Be relevant to baby-changing facilities and related amenities

By uploading photos, you represent that you have the right to share them and that they do not violate any third-party rights.

Content Moderation

We reserve the right to review, remove, or modify any user contributions that violate these Terms or our community guidelines, with or without notice. Repeated violations may result in account suspension, termination, or permanent ban from the service.

Reporting and Moderation

Users can report places for incorrect information, closure, inappropriate content, or other issues. When you report a place:

• The place may be immediately hidden from your map view
• Reports are sent to our moderation team for review
• We may contact you for additional information
• Abuse of the reporting system may result in account restrictions
• False or malicious reports may lead to account termination

Data Sources and Accuracy

Clover aggregates data from various sources including:

• The Great British Public Toilet Map (GBPTM)
• OpenStreetMap (OSM)
• User contributions
• Publicly available datasets

We make no representations or warranties about the accuracy, completeness, or reliability of this data. Facility information may change without notice, and we are not responsible for outdated or incorrect information. Always verify important details directly with the facility.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of information
• Warranties that defects will be corrected

We do not warrant that the App will meet your requirements or that it will be compatible with all devices or operating systems.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLOVER, ITS OPERATORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content
• Reliance on information provided through the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED £100 GBP OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER).

Indemnification

You agree to indemnify, defend, and hold harmless Clover and its operators, employees, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another.

Intellectual Property

The Clover App, including its design, logo, functionality, features, and content (excluding user contributions), is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our App or included software without our express written permission.

Third-Party Links and Services

The App may contain links to third-party websites, services, or resources. We are not responsible for the content, accuracy, or practices of these third parties. Your use of third-party services is at your own risk and subject to their terms and conditions.

App Store Terms

Apple App Store

If you download the App from the Apple App Store:

• These Terms are between you and Clover, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for any claims relating to the App
• You must comply with Apple's App Store Terms of Service
• Apple and its subsidiaries are third-party beneficiaries of these Terms

Google Play Store

If you download the App from Google Play:

• You must comply with Google Play's Terms of Service
• Google is not responsible for the App or its content
• Google has no obligation to provide support for the App

Termination

We may terminate or suspend your access to Clover immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws
• Abusive or inappropriate behavior
• At our sole discretion

Upon termination, your right to use the App will cease immediately. You may also delete your account at any time by contacting us.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will notify users of material changes by:

• Updating the "Effective Date" at the top of this page
• Providing an in-app notification
• Posting a notice on our website

Your continued use of the App after any changes to these Terms constitutes acceptance of those changes. If you do not agree to the new Terms, you must stop using the App.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of England and Wales. You agree to submit to the exclusive jurisdiction of those courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clover regarding the use of the App and supersede all prior agreements and understandings.
